Current content scope

JoinTheSwing prohibits users from uploading or publishing visual depictions of actual or simulated sexually explicit conduct. General member content submissions are disabled during prelaunch, and no submitted item may become visible without the required identity, consent, and pre-publication review controls.

Counsel-gated record-keeping position

Bare Getaways LLC has not published a final legal conclusion about primary- or secondary-producer status and has not designated a final custodian-of-records position. Qualified counsel must review the production, moderation, hosting, and publication workflow before any member visual content is enabled. If 18 U.S.C. §§2257–2257A or 28 C.F.R. Part 75 applies to any permitted content, the required records, labels, index, and custodian details will be established and published before that content can be accepted or displayed.

Until that review is complete, user-submitted visual content remains disabled and explicit material remains prohibited. This page does not claim an exemption or offer a definitive producer classification.

Age and consent records for allowed content

Before any allowed member content may be activated, the operating procedure requires adult identity and age verification for content creators, documented consent for every depicted person, a content-provider agreement, and moderation records. Those controls remain subject to provider, counsel, processor, and operational approval and do not convert prohibited explicit content into permitted content.

No expansion without review

JoinTheSwing will not expand into content that could trigger producer record-keeping duties unless applicable legal requirements, a counsel-approved record system, any required custodian details, creator agreements, labeling, and processor approval are in place first. Until then, such content remains prohibited and must be reported for immediate review.
