18 U.S.C. §2257 Record-Keeping Compliance Statement

Current content scope

A signed-in member may submit visual content. Every submission is recorded with a pending moderation status and is not visible to any other member until that status is approved. Members cannot approve or publish their own media. Approval is a staff action; it is not a self-service member action.

Depictions of actual or simulated sexually explicit conduct are prohibited. A member may mark their own media as intimate, in which case it is restricted to an adults-only, website-only channel and excluded from app-safe previews. Marking media as intimate does not permit prohibited content, and prohibited content must be reported for immediate review.

Account, age, and identity controls

At registration, the account holder accepts the Terms and the EULA and confirms that they are 18 or older, and that acceptance is recorded. JoinTheSwing separately operates an identity-verification program in which a third-party identity provider checks a government ID and performs an automated face-match and liveness check. The provider processes the ID and facial images under its own privacy notice and consent; JoinTheSwing never receives or stores those images and retains only a pass/fail result and a receipt. Depicted persons and consent

Members may submit visual content only where every depicted person is an adult who has consented to being depicted and to the visibility the member selects. The record JoinTheSwing holds for that requirement is the uploading account holder's attestation. A depicted person may report content through the process described below.

Producer and custodian position

Bare Getaways LLC has not published a final legal conclusion about primary- or secondary-producer status and has not designated a final custodian-of-records position. This page does not claim an exemption or offer a definitive producer classification. If 18 U.S.C. §§2257–2257A or 28 C.F.R. Part 75 applies to any content permitted on the service, the required records, labels, index, and custodian details will be established and published.

No expansion without review

JoinTheSwing will not expand the permitted content scope in a way that could trigger further producer record-keeping duties unless the applicable legal requirements, a counsel-approved record system, any required custodian details, creator agreements, and labeling are in place first.
